I. Operator
1. The operator is Kvido Bystroň, Jarcová 241, 757 01 Jarcová, IČO: 23876824. A natural person registered in the trade register. Competent authority according to § 71 paragraph 2 of the Trade Act: Municipal Office Valašské Meziříčí. Not a VAT payer. Contact for claims: info@3dbprints.cz.
II. Introductory Provisions
1. This claims policy regulates the rights and obligations of the contracting parties when claiming defects in custom production using the FDM 3D printing method and additional services (3D modeling, NFC products). It applies to orders from entrepreneurs (B2B) and natural persons — consumers (B2C).
2. Rights from defective performance are governed by Act No. 89/2012 Coll., the Civil Code. Provisions of Act No. 634/1992 Coll., on Consumer Protection, further apply to consumers.
III. Characteristics of FDM Printing — What is Not a Defect
1. Warning: FDM (Fused Deposition Modeling) is an additive manufacturing technology with natural limitations that are not a defect of the work: Visibility of print layers on the surface of the print; Dimensional tolerances of ±0.2–0.5 mm; Anisotropic mechanical properties; Limited water resistance; Color deviations; and Aesthetic imperfections in support areas.
IV. What the Contractor is Responsible For
1. The contractor is responsible for defects in the work existing at the moment of its handover: mechanical printing defects caused by the contractor, use of different material or color, dimensional inaccuracy exceeding tolerance, and obvious non-compliance with specs.
V. What the Contractor is Not Responsible For
1. The contractor is not responsible for defects caused by: errors in the 3D model provided by the customer, inappropriate choice of material by the customer, natural limitations of FDM, improper storage, mechanical damage after handover, and use in unsuitable conditions.
VI. Warranty Period
1. Consumer: The warranty period is 24 months from the handover of the work. If a defect appears during the first 12 months, it is assumed to have existed already at handover.
2. Entrepreneur (B2B): The contractual warranty period is 12 months from the handover of the work. The entrepreneur is obliged to notify the defect without undue delay.
VII. How to File a Claim
1. The customer is obliged to file a claim without undue delay after discovering the defect, by e-mail to info@3dbprints.cz. The claim must contain: order identification, description of the defect, photo documentation, and requested method of settlement.
VIII. Settlement of the Claim
1. The contractor will settle the claim within 30 days. In the case of a justified claim, the customer has the right to: free reprint, reasonable discount, or refund of the price of the defective part.
